TEMPORARY RESIDENCE AND WORK PERMIT
Single permit to reside and work is the most frequently chosen form of the legalization of residence in Poland. Its main advantage is the possibility of applying for residency and work in just one office, with a single application. However, the involvement of a prospective employer is necessary, as he/she has to fill in the relevant annex to the application. The company’s proprietor must present a document certifying that it is not possible to acquire for the position employers who are Polish citizens.
It is worth remembering that after two years of residence, a foreigner has a possibility of applying for a temporary residence permit for members of his or her family in context of the procedure of family reunification. Such a permit may be granted for up to three years. However, if you change a job, you need to resubmit the application.
RESIDENCE WITH A FAMILY
The Polish Act on Foreigners provides for the possibility of obtaining temporary residence permit for two eligible groups:
– temporary residence permits for family members of Polish citizens;
– temporary residence permits for family members of foreigners.
The second type of permit applies to families of foreigners if a foreigner staying in Poland is joined by the members of his or her family. Again, considered as a foreigner‘s family members are his/her spouse and minor children (under 18).
A residence permit for foreigner’s spouse and children is issued at the request of a spouse or parent staying in Poland. The procedure requires certain conditions to be fulfilled by both sides, both a foreigner residing in Poland and his or her close relatives who want to join him or her.
Foreigners to be joined by their family must prove that they have a stable source of income that is sufficient to live from for themselves and their family, as well as health insurance or confirmation of insurer’s coverage of medical treatment costs in Poland and a place of residence. Only foreigners who are beneficiaries of international protection in Poland (refugee status or subsidiary protection) are exempted from this obligation.
RESIDENCE PERMIT FOR THE PURPOSE OF CONDUCTING BUSINESS
In addition to the standard requirements (health insurance, stable employment, place of residence), which are provided in almost all types of temporary stays, foreigners applying in connection of running a business must meet some fairly stringent conditions. They need to present an appropriate level of income, then they must have an adequate employment level for a certain period of time. Only recently established companies may be exempted from this requirement. However, it is necessary to have necessary means to fulfill these criteria in the future.
RESIDENCE PERMIT FOR THE PURPOSE OF STUDIES
If a foreigner decides to start or continue first, second or third degree studies (bachelor’s degree, master’s degree or doctoral studies), it is possible for him or her to obtain a temporary residence permit.
Such a document is granted for the purpose of education for a maximum period of 15 months.
Another temporary residence permit will be issued to the foreigner for a maximum period of 3 years in line with general principles.
